罗兰岗殴打事件是2015年3月在美国加利福尼亚州罗兰岗发生的两起中国留学生欺凌、袭击事件。[1]

过程

2015年3月28日，两名中国籍人士在罗兰岗的一间餐厅和公园对一名16岁女孩施暴。[1]

2015年3月30日，另一件事件在Honeymee冰淇淋店发生，这家店位于科利马路（Colima Road）和富勒顿路（Fullerton Road）交叉口的Yes Plaza。 [2]这起事件的受害者是一名18岁女孩。 [1]加害者强迫她用手清理冰淇淋和烟头，然后带她到位于巴尼达大道（Banida Avenue）的罗兰岗公园，期间她遭脱光衣服、被巴掌打巴、用烟头烧、殴打，[1]甚至被强迫吃下被加害者从头上拔下的自己的头发。 [2]这次攻击持续超过五个小时。[1]

加害者与受害者

2015年3月30日事件中的成年加害人为杨玉涵（Yuhan "Coco" Yang）、章鑫磊（Xinlei "John" Zhang）及翟芸瑶（Yunyao "Helen" Zhai）[2][3]。另外三名加害者是未成年人。[4]翟芸瑶和章鑫磊也参与了3月28日的事件。[1]

受害者及加害者均为俗称“伞兵”的高中留学生，指的是没有父母或祖父母陪同，独自在美国读书的海外青少年。[5]基于这点，加州法官Thomas C. Falls将本案比喻为《蝇王》（Lord of the Flies）中所描述的无监督未成年人的故事。[2]

3月30日事件的受害者以及三名成年加害人[6]都就读于牛津学院（Oxford School），[7]该校是一所收纳大量国际学生的私立学校。到2016年2月，章鑫磊的父亲住在深圳。[8]

审判与定罪

2015年3月31日，成年加害人在受害人报案后被警方逮捕。[1]据报导，嫌疑人的保释金各为300万美元。其中一名嫌疑人的父亲因试图贿赂证人而遭到逮捕[4]。

加害人最初被控酷刑和绑架罪。根据加州法律，被判酷刑罪可判处终身监禁[9]。三名成年加害人最初均否认指控[7]，但最终接受了认罪协商。2016年1月5日，张某和翟某对绑架及以极大暴力造成重大身体伤害的攻击罪提出不抗辩答辩，杨某也作出不抗辩答辩。作为认罪协商的一部分，酷刑罪和两项绑架指控被撤销[9]。

加害人最终被送往加州州立监狱服刑。翟昀瑶由律师Evan Freed代理，判处13年有期徒刑[10]，杨悠涵获判10年，张心磊获判超过6年[11]。

20岁的陆正因提供剪刀予其他加害人但未直接参与攻击，于2015年12月被逮捕并与其他三名成年加害人分开审判，于2016年被判处三年有期徒刑[12]。

未成年嫌疑人则被判送入青少年矫正系统服刑[13]。服刑结束后，成年加害人将被遣返中国[14]。

监禁

截至2020年3月3日 (2020-03-03)，翟芸瑶（监号CDCR #WF4268）和杨悠涵（监号CDCR #WF4267）被关押在位于加州奇诺市的加州女子矫正机构（California Institution for Women，简称CIW）。[15]张心磊则已出狱。

后续影响

部分中国网民支持对加害人的惩处，因为中国大陆有许多类似的欺凌案件并未被追究刑事责任。[16]
