罗兰岗殴打事件是2015年3月在美国加利福尼亚州罗兰岗发生的两起中国留学生欺凌、袭击事件。[1]

過程

2015年3月28日，兩名中國籍人士在羅蘭崗的一間餐廳和公園對一名16歲女孩施暴。[1]

2015年3月30日，另一件事件在Honeymee冰淇淋店發生，這家店位於科利馬路（Colima Road）和富勒頓路（Fullerton Road）交叉口的Yes Plaza。 [2]這起事件的受害者是一名18歲女孩。 [1]加害者強迫她用手清理冰淇淋和菸頭，然後帶她到位於巴尼達大道（Banida Avenue）的羅蘭崗公園，期間她遭脫光衣服、被巴掌打巴、用菸頭燒、毆打，[1]甚至被強迫吃下被加害者從頭上拔下的自己的頭髮。 [2]這次攻擊持續超過五個小時。[1]

加害者與受害者

2015年3月30日事件中的成年加害人為楊玉涵（Yuhan "Coco" Yang）、章鑫磊（Xinlei "John" Zhang）及翟芸瑶（Yunyao "Helen" Zhai）[2][3]。另外三名加害者是未成年人。[4]翟芸瑶和章鑫磊也參與了3月28日的事件。[1]

受害者及加害者均為俗稱「傘兵」的高中留學生，指的是沒有父母或祖父母陪同，獨自在美國讀書的海外青少年。[5]基於這點，加州法官Thomas C. Falls將本案比喻為《蝇王》（Lord of the Flies）中所描述的無監督未成年人的故事。[2]

3月30日事件的受害者以及三名成年加害人[6]都就讀於牛津學院（Oxford School），[7]該校是一所收納大量國際學生的私立學校。到2016年2月，章鑫磊的父親住在深圳。[8]

審判與定罪

2015年3月31日，成年加害人在受害人報案後被警方逮捕。[1]據報導，嫌疑人的保釋金各為300萬美元。其中一名嫌疑人的父親因試圖賄賂證人而遭到逮捕[4]。

加害人最初被控酷刑和綁架罪。根據加州法律，被判酷刑罪可判處終身監禁[9]。三名成年加害人最初均否認指控[7]，但最終接受了認罪協商。2016年1月5日，張某和翟某對綁架及以極大暴力造成重大身體傷害的攻擊罪提出不抗辯答辯，楊某也作出不抗辯答辯。作為認罪協商的一部分，酷刑罪和兩項綁架指控被撤銷[9]。

加害人最終被送往加州州立監獄服刑。翟昀瑶由律師Evan Freed代理，判處13年有期徒刑[10]，楊悠涵獲判10年，張心磊獲判超過6年[11]。

20歲的陸正因提供剪刀予其他加害人但未直接參與攻擊，於2015年12月被逮捕並與其他三名成年加害人分開審判，於2016年被判處三年有期徒刑[12]。

未成年嫌疑人則被判送入青少年矯正系統服刑[13]。服刑結束後，成年加害人將被遣返中國[14]。

監禁

截至2020年3月3日 (2020-03-03)，翟芸瑶（監號CDCR #WF4268）和楊悠涵（監號CDCR #WF4267）被關押在位於加州奇諾市的加州女子矯正機構（California Institution for Women，簡稱CIW）。[15]張心磊則已出獄。

後續影響

部分中國網民支持對加害人的懲處，因為中國大陸有許多類似的霸凌案件並未被追究刑事責任。[16]
